Bail Bond Responsibilities

When you enter into a bail agreement with a bondsman, you become what is known as an “indemnitor.” You are agreeing to be the person responsible for the bail contract and the defendant. By signing an agreement with a bail bondsman, you agree to pay the bail bond premium in full. This is the fee that is set by the state of California. It is equal to 10% of the total bail amount. This fee is non-refundable. Even if the defendant is found not guilty or charges are not filed, this fee must be paid.

It is your responsibility to make sure that, once released, the defendant shows up at any court appearances. If the defendant fails to appear, you are responsible for any fees and administrative costs incurred by the bondsman, court costs and you will be responsible for paying the entire bail amount set by the Tulare County judge.

You must make sure that the defendant’s information, such as address and employer, remain current.  If the defendant leaves town or “goes on the run,” it is your responsibility to notify the courts and bondsman of their whereabouts, if they are known to you.
