What to Expect When Arrested on Drug Charges

When an individual is arrested and jailed on drug charges, they will be taken to the local police jail, or booking station. While there, they will be interviewed, photographed, fingerprinted, and booked into the county computer system. A long period of time may pass prior to the computer system showing information of a person’s arrest.

The individual may also be transported to a larger jail facility, which can take a much longer time. If you contact the jail too soon upon the arrest of your family member or friend, you may discover they have not been entered into the jail’s computer system yet. This is a normal process as the pre-booking period takes a while to complete.

Examples of Drug Charges

Drug charges are classified by their seriousness and penalty. Some drug charges can involve misdemeanors, such as the possession of small amounts of marijuana.

Felony charges can include: possession with intent to distribute (trafficking) with the exception of less than 28.5 grams of marijuana, the sale of anabolic steroids, possession of drug paraphernalia, intent to sell narcotics, possession of narcotics within 1500 feet of a school or housing project, cultivating (growing) marijuana, operating a methamphetamine lab or drug making facility.

The penalties for drug related charges throughout California can range from fines, to misdemeanors, to felonies, to life in prison, or the death penalty in serious cases.

Release from Jail

After an individual has been booked and processed, they may be released from jail on a bail bond or they may be held until their arraignment if no bail is posted for them. Arraignment will generally take place within two business days from their arrest.

For example, if someone is arrested on Thursday evening, they would generally be arraigned on the following Monday morning. Most bail bonds can be posted in California jails 24 hours a day, however, some inmates may have to remain in jail until their case settles in court.

Bail Bond Fees

The bail bond fee is mandated by the state of California and is 10% of the full bail amount. For example: If the amount of the bail is $10,000, the (premium) or cost of the bail bond would be $1,000 to have your family member or friend released from jail. This is a non-refundable fee.

Bail bonds typically require payment prior to the arrestees release from jail.

Court Responsibility

Once bailed out, both the indemnitor (bail bond signer) and the defendant must make sure the defendant attends every court date without fail. A warrant for the arrest of the defendant may be issued should they fail to appear in front of the judge. This is termed as “forfeiture.”

A missed court appearance may be a simple mistake which can be quickly corrected with a phone call to our bail company.

Should the defendant miss their court appearance, the bail company will call both the indemnitor and the defendant. If there was a miscommunication on the court date, the defendant was ill, stuck in traffic, etc., the bond company will schedule a new date with the court.

However, should the defendant purposely be avoiding prosecution, the bondsman will take action to locate and return the defendant to court. If for any reason the indemnitor feels the person they are bailing out may not make their court dates, or “skip bail,” they should think twice about it and leave them in jail, or wait until the defendant makes their arraignments.
