Prescription Fraud - California Penal Code 2002

If someone is arrested and charged for prescription fraud (2002 P.C.), it can be very serious.

As an example, if they are caught in the possession of counterfeited prescription drug blanks, they can be charged with the misdemeanor of prescription fraud.

The law states that no other person other than a physician, dentist, podiatrist, veterinarian or pharmacist shall write or issue any prescription.

Also, if a person knowingly possesses more than 3 counterfeited blanks, they shall be charged with a felony and punished via imprisonment in state prison or county jail.

There are several states which impose minimum sentencing guidelines, including prison time for prescription fraud, drug possession, distribution, manufacturing and trafficking.

Booking Process

Once an arrestee has been booked and processed into the county computer system, (which usually includes fingerprinting, photographs, and background checks) they may be eligible for release from jail.

If no bail is posted for them, they may be held until arraignment. Arraignment will generally take place within two business days. For example, if someone is arrested on Wednesday evening, they would generally be arraigned on the following Monday morning.

Bail can typically be posted at most California jails, 24-hours a day.

How Much Does Bail Cost?

The California bail schedule is established pursuant to the Uniform Bail Procedures Committee and approved by the judges of the Superior Court of California. Bail amounts are set according to the charges and individual county bail schedules.

Bail bond fees are regulated by the Department of Insurance. A bail bond in California costs 10% of the total bail amount. This means if the bail amount is set at $25,000 it will cost the non-refundable fee of $2,500 to bail them out of jail.
