Paying A Bondsman When Found Not Guilty?

QuestionWhen I was arrested, I was bailed out a week later with the help of a bail bondsman.  My dad  is paying $400 per month on my bail of $15,000.  Does my dad still have to pay the bail bondsman even if I am found not guilty?  It is important to me to have a better understanding of this because I have put my dad in a position that is not easy for him.

Answer:  Unfortunately,  regardless of the outcome of your case, the money is still owed to the bondsman.  By law, the bondsman’s fee is earned as soon as you are released from jail. The bondsman cannot legally give you or your dad a refund.

The cost of bail bonds in California is typically 10% of the full bail amount in most states, so it is likely your dad has arranged for a payment plan on a fee of $1,500.  This fee is paid so that you can remain out of jail while you await your trial.

LA County Jails To Need Billion Dollar Renovation

Recent charges of inmate abuse and mistreatment could cost Los Angeles County $1.4 billion.

The Los Angeles Times reported that the County Board of Supervisors could be asked to approve the replacement of the downtown Men’s Central Jail and the addition of space to the LASD Pitchess Jail.

Law enforcement officials in LA County agree that out-of-date Men’s Central facility makes it challenging for guards to adequately supervise inmates.  The plan also proposes adding approximately 400 beds to the Pitchess Detention Center, which could help offset additional capacity being seen due to California’s recently approved prison realignment program.

San Diego County Sheriff To Increase Crime Fighting Efforts This Holiday Season

San Diego County Sheriff Bill Gore said members of the Sheriff’s Department will be actively patrolling county streets this holiday weekend and will be keeping close lookout for impaired drivers. Those violating traffic violations due to speeding, as well as those not wearing seat belts, will be carefully monitored as well.

Gore points out that seat belts have “saved more lives than any other single piece of automotive safety equipment,” he said, “but in order for them to work they have to be used.”

He’s also urging to drivers to think twice before drinking and driving, and to consider designating a sober driver before embarking on a night out. Statistics provided by the National Highway Traffic Safety Administration indicate that Thanksgiving is the day when heavy traffic, drinking, and long-distance car trips combine to create fatal travel conditions.

California Prison Realignment Has Its Positives

In a Nov. 19 editorial in the Modesto Bee, newspaper staff point out that it may still be too soon to see how much of an impact the state’s jail realignment plan will have on local communities.

Public fear, they said, is due largely in part to irresponsible politicians and other parties who are in strong opposition to the plan.  Some politicians, whose offices are up for reelection in 2012, may be playing on fears spawned by state realignment as a campaign tactic.  That may also need to be taken into consideration.

Until more is seen regarding how local leaders deal with the influx of low-level, non-serious and non-sexual offenders into County jails, they say, a premature decision as to whether the plan is a good, or bad idea, is just that.

Newport Beach DUI Checkpoint Info For Friday Nov 18

The Newport Beach Police Department will be holding a sobriety checkpoint on Friday Nov. 18 on the northbound side of Jabmoree Road at Santa Barbara Drive.   The checkpoint will take place between the hours of 9 p.m. Friday night and 3 a.m. Saturday morning.

Bail Collateral Refund?

Here is another one of our answers to a bail bonds related question from Yahoo! Answers.  This answer was chosen as Best Answer by Voters.

Question:  I was the co-signer with someone to help bail a friend out of jail.  I was the one who paid the bail bond fee along with a security deposit that was to be refunded.  I was told  that we would get it back by a certain amount of time.  Who would receive the refund, myself or the main signer?

Answer:  If you placed a “security deposit” on a bail bond, it sounds like you used collateral  in the form of either cash, check, or credit card.  If that is the case, the collateral money that was  used will not be returned until the case is complete and all court appearances have been satisfied by the defendant.

Upon completion of the case, collateral will be returned by the bondsman to whomever placed it.

Tying up money and/or property for bail can be a real hardship. Next time you may want to look for a bondsman that offers no collateral bail bonds.

California County Jails Face Overcrowding from Realignment

During the first month after the new jail realignment plan was set in place, Orange County jails have received nearly double the number of inmates that was expected. This is raising concerns with county officials that there may soon be no empty beds.

The offenders being sent to county jails are those not considered violent and non-sex offenders. Orange County was told to expect about 143 additional inmates to its correctional system due to the realignment. In actuality, the county booked an additional 292 inmates last month.

Riverside County Will Charge Prisoners for Their Stay

On Tuesday, the Riverside County Supervisors approved the decision to charge county prisoners $142.42 per day for the length of their sentences at the Riverside County Jail.

The idea was proposed by county supervisor Jeff Stone. He feels that this plan could save the county between $3 million and $5 million each year. Riverside County jails house nearly 60,000 inmates annually.

Even though many criminals will not be able to afford paying this fee, it is estimated that nearly 25% of those who come through the jail system will be able to pay it.
