When someone is arrested for receiving stolen property (496 P.C.), it can be a serious crime. Called a ‘theft offense’, a person can be charged if they had knowledge that the property was stolen.
For example, the person/s must be aware that the property received was stolen; the property must indeed have been received, and the person who received the property must have intended to ‘deprive its owner’ of their property.
This crime can be charged as either a misdemeanor or a felony. If the property received has a value of less than $400 dollars, it may be charged as a misdemeanor, where the punishment may be less than one year in a California county jail. However, if the value of the property received is over $400 dollars, it will be charged as a felony where the maximum penalty can be 16 months to two or three years in a California state prison.
