Arrest and Booking Process
When someone is arrested for shoplifting, “petty theft,” they will be transported to a jail in the jurisdiction of their arrest. Generally, this will be a smaller, local jail. Once the defendant has been booked and processed they will be cleared for you to arrange for their bail. If the detainee is in a smaller jail, they may be processed fairly quickly. It’s important to realize that the booking process can often take several hours. Most bail bonds can be posted at California jails, 24 hours a day.
Also known as “petty theft,” the crime of shoplifting can be a serious charge and one that could go on a defendant’s record for a long time. The penalties, which can depend on the value of the property stolen, can vary from fines to probation from one to three years for the first offense. For the juvenile offender, the charge of shoplifting can be brought down to a minor infraction on the first offense so it doesn’t reflect on their permanent records. Typically, petty theft involves property stolen which holds a value at $400 or under. Petty theft can also carry a maximum sentence of 16 months inside of a state prison if charged as a felony. However, most courts deem the charge of petty theft to be a misdemeanor.
Grand Theft Charges
Grand theft is a charge that has to do with labor, money, personal or real property stolen, which is valued at $400 or more. It can hold a penalty which is punishable by up to one year in a county jail or 16 months within a state prison if the person doing the stealing has a prior theft conviction.
Evidence and Court
With cameras and security tactics companies and individuals are taking these days, people rarely get away with shoplifting. Evidence is used in a court of law to prosecute those that do the crime. It goes to say, that once the defendant is bailed out, both the indemnitor and the defendant must make every effort to attend all their court dates without fail. If they do not appear in front of the judge, a warrant for their arrest may be issued. In most cases however, a missed court appearance may just be a simple mistake that can be corrected with one phone call to our company.
