Embezzlement Charges & Crimes - California Penal Code 503
When someone steals small or large amounts of money, property or other valuable collateral over time or someone commits credit card fraud, creates false documents or records, false accounting sheets, and conceals a theft of this nature for any personal use, they will be charged with embezzlement (503 P.C.).
People such as employees of a company, clerks, letter carriers, or those who have special access to company funds who misappropriate them will be arrested and jailed for embezzlement. Embezzlement is also known as a “white collar crime.” Charges may include time in county jail, state or federal imprisonment, parole, probation, judgment, restitution to pay the victims of the embezzlement, large fines and prison time of up to 20 years depending upon the value of assets embezzled and other considerations.
Release from Jail
Release from most California jails can take anywhere from 4 to 12 hours or more depending upon the number of inmates at the jail facility and how busy the staff is. California Penal Code §851.5 establishes the right of a person arrested to make at least 3 free local phone calls upon being booked: one to an attorney, one to a bail bond agent, and one to a family member, or personal friend. After the individual has been booked, they may be released from jail on bail bond or otherwise or they may be held until arraignment if no bail is posted. Arraignment generally takes place within two business days. As an example, if someone is arrested on Wednesday evening, they would generally be arraigned on the following Monday morning.

Bail Costs in California
By law, a bail bond in California costs a fee of 10%. This is a non-refundable percentage of the total amount of the bail. For example, should the bail amount be $15,000, your portion will be $1,500. It’s as easy as that. There are no additional taxes or added on fees ever added. We’ll let you know the exact cost of the bond before anything is written.
What Is Your Responsibility?
Should you choose to bail someone out of jail, you will be named as the indemnitor. This means that you will assume full responsibility that the individual (defendant) will show up for their court dates. If for some reason, they fail to appear, you will be held responsible in assisting the bail bond company in locating them and returning them to court. Should the defendant not be located, you will be responsible for paying the total amount of bail. Keep in mind that the majority of bail bond issues such as these can be easily resolved. Rarely, do they escalate beyond a simple phone call to straighten out the situation.
